These are the terms for using LocalLetters. They’re written to be read. By signing up or using the service, you agree to them on behalf of your business.
Who you’re dealing with
LocalLetters is run by [LEGAL ENTITY NAME], [MAILING ADDRESS] (“we”, “us”). “You” means the business that signs up and the people who use the account for it. You need to be at least 18 and allowed to sign up for the business.
What we do
- Monthly plans. Every month we write letters in your handwriting, with a real pen, to households that recently moved into your zip, and mail them. Your plan sets the most letters a month (Starter up to 50, Growth up to 100, Scale up to 250). How many households move in varies month to month, so we can’t promise a number; the plan is a ceiling, not a guarantee.
- One business per trade per household. Through us, no household hears from two businesss in the same trade. Some zips are held by one business; bigger zips may be shared, with the households split between you. What you get is what the zip check and your welcome email said when you signed up.
- One-time sends are quoted case by case. You see the price before you pay, and nothing is mailed until it’s paid.
- You approve the words. You can see and change your message in the app. Nothing has to go out that you haven’t had the chance to check.
Billing, changes and cancelling
- Plans are billed monthly, in advance, to the card you give Stripe at checkout, at the price shown there.
- Upgrading takes effect right away; you’re charged the prorated difference for the rest of the month. Downgrading takes effect at your next billing date.
- Pausing an area stops its mail. Your plan keeps billing while it’s paused. To stop billing, cancel.
- Cancel any time from Billing in the app, or by texting us. Cancelling stops future charges. Your plan stays active until the end of the period you’ve already paid for; after that your mail stops and your zip is released to the next business in line.
- If a payment fails and isn’t fixed, we stop mailing for that plan and may release your zip.
Refunds
Payments aren’t refundable, except where we decide to refund (we’re reasonable; text us) or the law requires it. If we fail to mail letters you paid for, we’ll either send them late or refund them, your choice.
Your handwriting and your words
- Your handwriting, logo and messages stay yours. You let us use them only to make and mail your letters and to show you previews. We never use your handwriting for anyone else.
- You’re responsible for what your letters say: that it’s true, that you’re allowed to say it, and that any offer in it is one you’ll honor.
What you can’t use it for
No unlawful mail. That includes anything deceptive or misleading, threatening or harassing, discriminatory, pretending to be someone else, or breaking advertising, licensing or privacy rules that apply to your business. We can refuse, hold or stop any letter or account that we reasonably think breaks this.
Mail, data and the post office
- Once mail is handed to the U.S. Postal Service, delivery is up to them. We’re not responsible for postal delays or lost mail.
- New-mover records come from outside data providers. They’re usually right, not always; we can’t guarantee every record.
- We can’t promise results. Most people read a handwritten letter; whether they call is up to them.
The legal limits
- The service is provided “as is”. To the extent the law allows, we don’t make promises beyond what’s written in these terms.
- To the extent the law allows, we aren’t liable for indirect or consequential losses (like lost profits or lost business), and our total liability for any claim is limited to what you paid us in the three months before it.
- If someone makes a claim against us because of what your letters said, you’ll cover our reasonable costs of dealing with it.
Ending
You can cancel any time, as above. We can suspend or close an account that doesn’t pay or breaks these terms; if we close an account for any other reason, we’ll refund the unused part of the current month.
Disputes
If something goes wrong, text us first; most things get fixed that way. These terms are governed by the laws of [STATE], and any dispute goes to the courts in [COUNTY, STATE].
Changes
We may update these terms. We’ll change the date at the top, and email customers before a change that matters takes effect. Using the service after that means you accept the new terms.
